Back in Chile in May 1999 Special Prosecutor Archivaldo Loyola ordered his imprisonment in Traiguén accusing him of usurpation of land, theft of wood and misprision of felony. Other leaders of the CAM were also accused of the same crimes.
The legal charges caused Cayuqueo to leave his law studies in Temuco Catholic University. He spent time in the prisons of Lebu, Traiguén and Nueva Imperial. After an internal fracture in Coordinadora Arauco-Malleco Cayuqueo left the organisation in 2001.
