The 129th General Assembly Wagoner served as the Chairman of both the Judiciary Committee and the Rules and Reference Committee. Additionally, he was on the War of 1812 Bicentennial Commission. He did not run for his second term in 2012.

Wagoner had to contend with two other candidates in the primary election of 2008 and won with more than seven percent of votes. He also faced Democrat Jackie Brown in the general election, and again came out on top.

In the summer of 2017, Wagoner announced his intention to run for Lucas County Republican Party Chairman. On February 7th, 2018 Wagoner supporters filed 276 petitions to run as candidates for the Lucas County Republican Central Committee. The incumbent, Jon Stainbrook, filed 312 individual precincts. On June 9, 2018, Wagoner won election as the Lucas County Republican Party Chairman.

Wagoner was initially thought of as a possible replacement for state senator Randy Gardner late in 2007. But his transition into Senate in Ohio Senate was expedited after congressman Paul Gillmor unexpectedly died. This triggered a series of legislative shifts in which Rep. Bob Latta was elected to Gillmor’s Congressional seat, which allowed the term-limited Senator Gardner to take over his previous Ohio House seat. Thus that the 2nd Senate seat currently vacant, Senator Wagoner was chosen early for the seat he had been aspiring to.

In the face of the incumbent Lynn Olman term limited and ineligible to seek the fifth time Wagoner was elected to represent the 46th district of the Ohio House of Representatives in 2004. Wagoner was undefeated in his primary and then faced Nancy Patrick Greeley in the autumn. He was elected to his seat in the year 2006.

Following his election to the Senate, Wagoner was elected Majority Whip by his colleagues. However, early in 2010, Wagoner resigned his post and was replaced by Senator Steve Buehrer. Wagoner cited personal and professional problems as the reason for him leaving his post, but many cite his controversial speech in support of Governor Ted Strickland’s decision to raise the income tax rate in Ohio.
