Roush was nominated by the Senate to serve a 12-year term beginning March 1, 2016. The nomination was rejected by the House with 38 to 55 votes. The General Assembly later that month elected Stephen R. McCullough, then-Judge, to fill the vacant seat for a full term.
Governor Terry McAuliffe appointed Roush to fill in the vacancy left by Justice LeRoy F. Millette, Jr., effective July 27, 2015. This interim appointment, according to the Constitution of Virginia was due to expire 30 days after the start of the next session of Virginia General Assembly unless she is elected by the legislature to a full 12-year term. The General Assembly met in special session on August 17, 2015. However, no one was elected to the full twelve year term.

The governor declared that the legislature was not in session, and he intended to re-appoint Justice Roush for an interim term. It is not clear if the second interim appointment was valid or ineligible. The second interim appointment, if valid, expired on February 12, 2016, thirty day after the regular session of General Assembly started on January 13. This was because the legislature didn’t elect her for a full twelve year term.
