Potter explained to Colbert’s audience the Citizens United v. Federal Election Commission decision made by the United States Supreme Court that allowed the creation of “Super PACs”, and was the lawyer behind the creation and functioning of Stephen Colbert’s PAC, “Americans for a Better Tomorrow, Tomorrow”. Colbert, together with Potter acting as his attorney, demonstrated how easy it was to circumvent the laws governing Super PACs. Speaking in 2014, Trevor Potter said:

The segments of the Colbert Report about “Super PACs” were recognized in 2011 by an award of a Peabody Award for parody reporting as an “innovative means of teaching American viewers about the landmark court decision”. Reminiscing about the experience in the year 2015 Potter declared, “I was his legal counsel for the project that meant I was responsible for everything from writing an Federal Election Commission Advisory Opinion Request to accompanying Colbert to court hearings. I even came up with ways to have the funds “disappear” out of the public’s view at the time the PAC was shutting down. (Hint it’s not too difficult.) … The last thing I learned from my time with Colbert was a realization of the massive and negative effect Citizens United has had on our campaigns and our elections.”
