The Oklahoma Attorney General declared that the state didn’t have enough execution drugs on October 13, 2014. This delayed Glossip’s execution. The U.S. Supreme Court stopped executions in Oklahoma on January 28, 2015, until it decided on lethal injection drug.
According to a report on October 16, 2015, due to a grand jury investigation, it was likely the state would not conduct an execution for more than a year.
On October 8, 2015, it was reported that Oklahoma Corrections Department officials used potassium acetate to execute Charles Frederick Warner on January 15, 2015, contrary to protocol. An attorney representing Glossip and other Oklahoma death row inmates said logs from Warner’s execution initialed by a prison staff member indicated the use of potassium chloride; however, an autopsy report showed 12 vials of potassium acetate were used.
Glossip was convicted of murder by a second Oklahoma jury in August 2004 and sentenced to death. Glossip claimed that prosecutors had forced his defense attorney to resign. However, the Oklahoma Court of Criminal Appeals affirmed Glossip’s death sentence in April 2007. It included two judges who were in the majority, one special concurring judge, and two dissenting judges. Glossip was able to draw the support of Sister Helen Prejean but the Oklahoma Court of Criminal Appeals did not allow the clemency board the opportunity to review letters from Sneed’s relatives, who believe that Sneed is lying.

Justin Sneed killed Barry Van Treese with a baseball bat on January 7, 1997. The murder took place at Oklahoma City’s Best Budget Inn, Oklahoma. Van Tresse was the property owner. Sneed was the maintenance person and Richard Glossip the manager. Sneed admitted to the crime and said that Glossip instructed him to murder in exchange for the death penalty being avoided.
Glossip refused to compromise his innocence and insisted that he be proved innocent. Glossip was convicted of murder by an Oklahoma jury in July 1998 and sentenced to death. The unanimous Oklahoma Court of Criminal Appeals tossed that conviction in 2001. The case was originally titled Warner v. Gross, but Glossip replaced Charles Frederick Warner as the plaintiff after Warner was executed in January 2015, also by Oklahoma, before the case was decided.

On September 28, 2015, the Oklahoma Court of Criminal Appeals voted 3-2 to proceed with execution. Presiding Judge Clancy Smith wrote “While finality of judgment is important, the state has no interest in executing an actually innocent man. An evidentiary hearing will give Glossip the chance to prove his allegations that Sneed has recanted, or demonstrate to the court that he cannot provide evidence that would exonerate him.” Judge Arlene Johnson wrote that the original trial was “deeply flawed” and an evidentiary hearing should be ordered.
