On September 7th the 7th of September on September 7, 2016, Judge Robinson determined that CoreCivic, a prison operator for profit, CoreCivic, had illegally recorded phone conversations between lawyers and their pre-trial clients incarcerated in the Leavenworth, Kansas prison. The defense attorneys representing the inmates protested when they discovered that their confidential meetings with their clients were recorded in spite of CoreCivic having repeatedly promised them that the conversations would remain confidential. Robinson accused prosecutors of speeding ahead with an alleged prison contraband casethat she described as an “horrendous circumstance. Robinson declared, “You all need to get your act together,” Robinson granted large latitude for an investigation into telephone calls and footage of meetings between lawyers and prisoners in the Leavenworth Detention Center. Robinson announced that she was planning to require to the U.S. Department of Justice to fund an investigation that is likely to run into the hundreds of thousands. Prosecutors say they obtained the recordings accidentally while acquiring evidence of the prison contraband ring which could include more than 95 prisoners and 60 people who are not inmates. A subpoena from a grand jury resulted in the release of recordings of meetings between lawyers and clients. Numerous attorney-client calls were given to attorneys involved in the case. Robinson stated that it appeared that the rights of prisoners were infringed. The FBOP prohibits recording in rooms for attorney-client meetings however CoreCivic is the company that runs the prison, claims that silent video recordings of inmate attorney meeting “are a standard practice” across the country and are utilized for prison security. In August of 2016, Robinson ordered the recordings to be stopped. CoreCivic gives attorneys of prisoners the option of having these recordings to be removed for meetings with clients. However, defense attorneys told the court that phone calls between him and his client at Leavenworth were recorded, despite numerous requests to have these recordings stop and his received confirmations by CoreCivic they had assured him that this practice had been halted. Barry Pollack, president of the National Association of Criminal Defense Lawyers stated, “You have a failure on the part of the institution that is recording something that it shouldn’t be. Here, they turned it over to the prosecutors.” “Anyone facing prison time needs legal counsel, and essentially, they aren’t getting it.” The illegalities that were involved led to the reviewing sentencing for cases. A defendant named Michelle Reulet, was released nearly three years before her scheduled date when it was discovered that CCA recorded her conversations with her attorney and the U.S. Prosecutor’s office.

Robinson was named an United States District Judge by President George W. Bush on September 10, 2001 to fill the vacancy left from George Thomas van Bebber. Robinson was confirmed by United States Senate in December 11th, 2001 and was appointed on the 13th of December, 2001. She was named Chief Judge on May 1, 2017.

She also sanctioned Kansas Secretary of State Kris Kobach for violations of the Federal Rules of Civil Evidence during the trial. She ordered him to complete six hours of continuing legal education pertaining to either the Federal Rules of Civil Evidence or Kansas rules of civil evidence.
