Eric McDavid (born October 7 1977) is an American green anarchist who was found guilty of conspiring with others to utilize explosives or fire to destroy government and corporate property. After spending an eight-year period and a total of 360 days jail the conviction was reversed after it was revealed that the FBI was not able to provide any evidence that could be exculpatory in the case to defense. Although U.S. Attorney McGregor W. Scott has declared McDavid one of the first people within the U.S. to be prosecuted for Earth Liberation Front (ELF)-related charges The trial showed that McDavid’s organization was not able to decide whether or not they would claim the actions planned under on behalf of ELF. He was found guilty of a felony and was sentenced to 20 years of prison. In January of 2015,, a federal judge granted McDavid to be released from prison after the prosecution acknowledged that it had omitted hundreds and pages of documents.

On January 8 in 2015. McDavid got released after the FBI admitted that it kept 2,500 pages of documents which could be beneficial to his defense that included love letters written by “Anna” and McDavid and evidence that she was disqualified from taking an FBI polygraph test administered by her agent Special Agent Ricardo Torres. The release was granted as a condition of his of a lesser charge for general coercion.

Attorney for defense Mark Reichel argued that “Anna” played the role of a provocateur by inducing the group to concentrate on a specific target, paying for meetings and other supplies and informing the group to take action when they were hesitant. Reichel declared during the trial “the fresh $100 dollars, as well as the Dutch Flat cabin where the group was residing in the time prior to the trio’s arrest – all supplied through “Anna” thanks to her FBI sponsors…That’s the creation of a case…Without ‘Anna,’ you have nothing.”

In May, 2009 McDavid’s lawyer filed an appeal. The appeal was rejected in 2010. He was sentenced to FCI Victorville as inmate 16209-097.
