Yong Vui Kong is one of the most popular and richest Drug Trafficker who was born on January 23, 1988 in Sandakan, Sabah, Malaysia. Yong Vui Kong, a Malaysian citizen of Hakka descendance was sentenced in Singapore to death for trafficking more heroin than 15 grams in 2007. As a result of the amendments to Singapore’s Misuse of Drugs Act, his sentence was reduced to life imprisonment or caning.

Ravi applied to the High Court for permission to contest the clemency process through judicial review. M. Ravi was denied the application and M. Ravi appeared before the three same judges who heard Yong’s appeal in the appeal against leave application. The appeal against this judgment was dismissed by the Court of Appeal on 4 April 2011. The High Court’s conclusion that the President had no personal discretion in exercising the clemency powers was confirmed by the Court of Appeal. He was obliged to follow Cabinet’s advice. This conclusion was made evident by the text of Article 22P(1), the legislative history and relevant case law as well as the Constitution’s description of the President’s powers.

Subsequently, M. Ravi applied before those three judges in the Court of Appeal once more to re-open its decision on Yong’s appeal in March 2012, alleging that Yong had been discriminated when the Attorney-General, in his capacity as the Public Prosecutor, decided to charge Yong for capital offences while applying for discharges not amounting to acquittals for the mastermind behind Yong. The new argument was based on a recent judgment in January that year where the three judges ruled against another drug trafficker represented by M. Ravi, that while the prosecutorial discretion is subjected to judicial review, the applicant failed to produce evidence that the Public Prosecutor took into account irrelevant considerations or was biased in his decision. This application was also dismissed on 4 April 2012.

On 14 November 2013, Yong’s death penalty was officially lifted. He has become the first drug trafficker on death row to have his sentence reduced to life imprisonment and caning (15 strokes), under amendments made to the Misuse of Drugs Act. On 22 August 2014, M. Ravi appealed against the new sentence, this time before Chief Justice Sundaresh Menon, Judge of Appeal Andrew Phang and Justice Tay Yong Kwang, that the caning imposed on Yong is unconstitutional. This appeal was dismissed on 4 March 2015.

Kelvin Lim represented Yong in the High Court. Justice Choo Han Teck, the trial judge, asked Yong to reduce the charges against him due to his young age and the fact that execution is mandatory for anyone convicted of trafficking more than 15g (0.53 oz). Yong was convicted and sentenced to the death. Yong, through his lawyer at the time, appealed against the conviction and sentence but withdrew it the 29th April 2009, the day before the appeal hearing. On 11 August 2009, Yong filed an appeal against the conviction and sentence. However, he withdrew it on 29 April 2009.

Yong hails from Sabah in Malaysia. In 2007, he was working as a “runner”, which is a courier or mule for an unknown criminal boss. Rajah. Ravi’s argument that Yong had withdrawn his appeal because he believed he couldn’t re-argue about the constitutionality of the death penalty in light of previous court decisions, such as Van Tuong Nguyen, was accepted by the court. On 15 March 2010, the three judges heard the appeal. On 14 May 2010, the court ruled in Yong Vui Kong v. the Public Prosecutor, that the mandatory death penalty imposed under the Misuse of Drugs Act was not in violation of Articles 9(1) or 12(1) of Singapore’s Constitution.

In July 2012, the Singapore government agreed to ratify changes to the mandatory death sentence for drug trafficking and murder offenses – those currently on death row may apply to have their death sentence reduced to life imprisonment.
