Joseph had been released from the team on Sept. 6, 2009. following the team purchased Richard Seymour from the New England Patriots and then renewed on September 11 when Seymour did not show up. But, when Seymour was seen in his Raiders base, Joseph was again released on September 14. He was re-signed on November 9.
Joseph was sentenced on November 30, 2012 to two years in prison, to be followed by three years of supervised release, for his participation in an identity theft tax refund fraud scheme. Joseph pleaded guilty on August 31, 2012, to one count of theft of government money and one count of aggravated identity theft.
On April 30, 2012, Joseph along with two other former NFL players were arrested on federal charges in connection with an alleged scheme to steal people’s identities and file false tax returns.
The Oakland Raiders signed Joseph on March 14, 2008. They released Joseph on September 2, and then signed him again on November 5, 2008. The 2008 season ended with eight sacks.

Joseph was a starter in all games (51 with bowl games included) during the course of his Miami career. In 2002 , as a senior Joseph made the first team All-Big East selection, making 51 total tackles (19 solo tackles) and 16 tackles for losses and five quarterback sacks. He also stopped five passes and recorded an all-time high of 29 quarterback hurries. In 2001 , as a junior he earned third-team All-American through The Associated Press and second-team All-Big East when he led his team with quarterback sacks (10) and tackles lost (19). He also recorded 61 tackles. He also made total tackles, including the number of 40 (15 solos) and three quarterback sacks as well as twelve quarterback rushes. Joseph was an 1999 The Sporting News second-team freshman All-American. He started the season at defensive end, but later moved to tackle. He racked up 49 tackles, including 6 tackles lost, 1.5 sacks, 17 quarterback rushes, two break-ups, one forced to fumble and one that was recovered.
Joseph was selected to the New York Giants with the 25th overall selection in the 2003 NFL Draft. After a holdout , he signed an agreement for five years worth of $6.95 million contract on the 5th of August in 2003. He was a part of 14 games during his rookie season in the reserve position, mostly as a defensive tackle. He finished the season with six tackles (3 in one go) as well as 1 sack and one forced fumble. The year 2004 saw him was a part in 15 games and had 4 starts. He recorded 25 tackles (20 in one go) two sacks and two passes defended. In 2005, he started every game of the regular season where he played, as well as played in the NFC Wild Card Game at the right defensive tackle. He ended his season by completing 19 stops (14 by himself) 2 sacks three passes defended and one fumble recovery. He was unable to play in six of his last seven regular season games because of injuries. The following season, in 2006, he was a part of every game of the league with three starts, and registered 21 tackles as well as 2 quarterback sacks.
