After just eight days of Banta-Cain’s release by the 49ers the team was signed to the New England Patriots on February 18 2009. Banta Cain was released on the 19 and was reportedly signed the following day to a contract extension for this season. The signing, however, was not officially signed until the close of regular-season play. He was the starting quarterback in all of the games played the 2009 season, scoring 55 tackles as well as a career-high 10 sacks.

The team posted an overall record of 7-9. He was let go by Mike Singletary on February 10 09, 2009.
