Merritt is a well-known figure ever since he was featured in an article by Jennifer Egan, Uniforms in the Closet: The Shadow Lives Of Gay Marines on The New York Times Magazine’s June 28 1998 cover.
Merritt was discharged from the Marines in August 1998. He enrolled immediately at the University of Southern California Law School. Max Harrold, a freelance journalist, approached Merritt to interview him about a story he wanted to pitch to The Advocate. The Advocate is a leading national news and information magazine that serves the lesbian/gay community. Merritt accepted and Harrold and Merritt met Judy Wieder, The Advocate’s editor-in–chief. She agreed to publish the story as part of the double-issue end-of-year issue, which featured a compilation of noteworthy events from 1998. The issue’s cover featured George Michael, a singer who was just arrested for public masturbation.
In August 1998 Merritt enrolled at the University of Southern California Law School in Los Angeles and graduated with a Juris Doctorate in May 2001. He was a summer associate at the LA office of the international law firm Jones Day and became an associate after law school. He was admitted to the California Bar Association in December 2001.
The February 16, 1999 edition of The Advocate exposed Merritt’s secret career in gay pornography in a cover story titled The Marine Who Did Gay Porn.
Merritt was an op-ed writer for the Navy-Marine Corps Times from 1996 to his resignation in 1998. The newspaper is owned by Gannett and distributed on US military installations around the world. The Times featured a section called “Back Talk”, where one Sailor or Marine could share their views on different aspects the service. Merritt was encouraged by the Times to use a pseudonym in order to be able speak freely without fear of repercussions. He chose “Buster Pittman” as his dog’s name. Merritt was allowed by the Times editors to use his column for controversial positions, such as allowing women in combat and reducing the penalty of adultery from being a felony to a misdemeanor. Merritt also repealed “Don’t Ask, Don’t Tell” to allow gay men and lesbians to openly serve in the military.

Merritt enlisted soon after his eighteenth year. In January 1986, he left for South Carolina to join the United States Marine Corps (the Marine Forces Reserve). After boot camp, he attended an occupational school at Huntsville’s Redstone Arsenal. Merritt then returned to Greenville, where he joined the Marine Corps Reserve unit. This is a company that employs ammunition technicians. Merritt was promoted to sergeant in May 1990. However, Merritt was still transitioning to the officer program and did not deploy with his reserve unit to Operation Desert Storm. Merritt resigned from the Marines in August 1998.
Merritt was the son of fundamentalist Christian parents. He was born in Greenville South Carolina. Merritt attended Bob Jones University’s elementary and secondary schools. He worked at The Wilds, an evangelical Christian camp, during his high school summers. After two years at Bob Jones University, he transferred to Clemson University in 1988.
Merritt had not yet grappled with the issue of his homosexual orientation. In his memoirs, Merritt claimed that when he attended Bob Jones Junior High School, Bob Jones III, then-president of BJU, said at a White House anti-gay protest that “homosexuals should be stoned to death as the Bible commanded.” In June 1998, Merritt was featured on the cover the New York Times Magazine in a story about gay people serving the US military under the don’t ask, don’t tell policy. Merritt was only identified in the article by his initial R. Military authorities soon identified Merrit as the subject of the article, but because Merritt was not explicitly named in the article, he was not charged with sodomy under the Uniform Code of Military Justice
