On February 12, 2018, President Trump announced his intent to nominate Phipps to a seat on the United States District Court for the Western District of Pennsylvania. On February 15, 2018, his nomination was sent to the United States Senate. President Trump nominated Phipps to the seat vacated by Terrence F. McVerry, who assumed senior status on September 30, 2013. On April 25, 2018, a hearing on his nomination was held before the Senate Judiciary Committee. On May 24, 2018, his nomination was reported out of committee by a voice vote. On October 11, 2018, his nomination was confirmed by voice vote. He received his judicial commission on October 17, 2018, and was sworn in on October 23, 2018. He received his judicial commission on July 17, 2019.
