The Australian A-League team Melbourne Victory announced on 23 May 2008 that Fabiano had been signed to a two-year contract. This was after two outstanding performances against them in 2008 AFC Champions League. Fabiano received an Australian work permit shortly after the announcement. His transfer to Melbourne Victory was officially completed on the 1st of July 2008, when A-League’s transfer window reopened. According to Fabiano, Fabiano stated that he wanted to be professional in his approach to adapt to the A-League’s higher standards. Pre-season was Fabiano’s best season, scoring two goals, a tap-in against Whittlesea Zebras and a bullet header against Adelaide United in Week 9 of the 2008/09 A-League Pre-Season Cup.
Ney Fabiano scored against Wellington Phoenix his first goal of the regular season in Round 2. After being accused of spitting on Robert Cornthwaite, Ney Fabiano was sent to the tribunal and received a red-card in round 4. The tribunal was notified immediately and the red card was increased to an eight- match ban on the 17th September. This charge was reduced to a six match ban after an appeal.
