Shih filed for retirement as a prosecutor shortly after he left his position at the Ministry of Justice in May 2008. This would allow him to receive a higher pension. The appeal was rejected by Wang Ching-feng, his successor. In 2011, Shih was accused of fraud related to the use of special allowance money. After the decriminalization of special allowance funds, Shih was cleared of all charges in 2011.
Many speculated that Chen’s successor would be Shih. In January 2005, Frank Hsieh appointed Shih as premier and he took office with the Hsieh cabinet on February 1, 2005. After Su Tseng Chang-chang, Chang Chun-hsiung took the premiership, Shih remained in his position. Shih led multiple investigations into electoral fraud throughout his tenure. He also investigated corruption, insider trading and organized crime. Shih also promoted initiatives against drug crimes. Shih began work in 2006 to establish a “conditional moratorium on the death penalty”, which would reduce executions on Taiwan’s death row.

Morley Shih is a Taiwanese judge and prosecutor. He studied at National Taiwan University, and began his legal career there in 1976. Shih was elected Minister of Justice in 2005. He served until 2008.
In 1976, Shih started his legal career with the Taichung District Prosecutors’ Office. He was appointed a Taichung District Court judge in 1982. After two years, Shih was elected chief justice of Taichung District Court. After stepping down as chief justice of the Taichung District Court Court, Shih was appointed chief prosecutor at the Taichung District Police Office. The Prosecutors Reform Association conducted a January 2000 election in which Shih was the winner. The following year, Chen Ding-nan, Minister of Justice, named Shih as chief prosecutor in Kaohsiung. In the following year, Shih was appointed to head Taipei District Prosecutors Office. He held the post until 2004, when Chen named him Vice Minister of Justice.
