His judicial commission was granted on July 13, 2018.

Mark Jeremy Bennett (born February 24 1953) is a United States Circuit Judge in the United States Court of Appeals for the Ninth Circuit.
in 1976 Bennett earned his bachelor of Arts degree in political science at Union College in Schenectady. Bennett attended Cornell Law School in Ithaca where he served on the Board of Editors of the Cornell Law Review. In the same institution, he earned his Juris Doctor in 1979. After the law college, Bennett became a law clerk for the Chief Justice Samuel Pailthorpe King of the United States District Court for the District of Hawaii. Following his court clerkship Bennett worked as the Associate United States Attorney for the District of Columbia from 1980 to 1982 and then for in the District of Hawaii until 1990. Then, in 1991 Bennett began his own private practice, as a partner of McCorriston Mukai MacKinnon. McCorriston Miller Mukai MacKinnon LLP. While there Bennett was working pro-bono for the office of the attorney general as well as taught law in the William S. Richardson School of Law. He was attorney general of Hawaii from 2003 until 2010 , during the administration of two terms under Republican Gov. Linda Lingle.
On August 16, 2019, Bennett was in the majority of a split panel for the Ninth Circuit which blocked new asylum restrictions by the Trump administration within its own jurisdiction but declined to block the new asylum rules across the entire nation.
