Hamida Barmaki was a Kabul native, born on 4 January 1970. After graduating from Ariana High School, Kabul (1977-1987), Hamida Barmaki studied law at Kabul University’s Faculty of Law and Political Sciences. She was able to achieve outstanding academic results, which enabled her to be one of the first Afghan women to pursue a career as a judge. Hamida Barmaki enrolled in the Attorney General’s Office’s postgraduate course to learn more about law practice. She returned to Kabul University in 1992 as a professor of law (1992-2011).

The Institut International Pour Les Etudes Comparatives (IIPEC) was the Project Coordinator. It also served as the Head of Law and Political Sciences at Kabul University’s National Center for Policy Research (2006-2008), the Legal Advisor to Afghanistan Research and Evaluation Units (AREU (2006), the Director of Women’s Islamic Rights Awareness Program of The Asia Foundation (2004) and Program Manager of Afghan Women Lawyers’ council (2003-2004).

In 2009 Hamida Barmaki was appointed Child Rights Commissioner of the Afghan Independent Human Rights Commission (AIHRC) while additionally keeping her responsibilities with the Max Planck Institute. Through her new position, she gained not only a nationwide but an international reputation. Hamida Barmaki was deeply concerned about the vulnerability of children in war-torn Afghanistan and travelled to many provinces to consult with AIHRC staff and investigate cases. She even commissioned research and openly criticized the government. Among the research conducted was a study on child abuse indicating an increase in the number of such incidents. Immediately after the publication of the study, Hamida Barmaki initiated the first MPIL-AIHRC seminar on women and children’s rights. Meanwhile, her struggle against the recruitment of minors by the Afghan security force and against the practice of bacha bazi (sexual slavery of boys), was just becoming effective. A mutual agreement between the respective representatives of the Afghan state and the United Nations was planned to be signed two days after her killing. Professor Barmaki was also concerned about child marriage. Together with civil society activists, academics, and lawyers from state institutions, she developed marriage forms and other tools aimed at bettering the protection of female minors.

In addition to having graduated from the Faculty of Law and Political Sciences of Kabul University, she obtained a master’s degree in Development, Innovation and Change (MiDIC) from the University of Bologna, Italy. In December 2010, she received an invitation by the Max Planck Institute for Comparative and International Private Law (Hamburg, Germany) for a research stay to begin working on her doctorate in law. At her home faculty, Hamida Barmaki struggled to establish an LL.M. program which she believed to be an essential tool for the development of a new generation of excellent lawyers, which were urgently needed inside the country.

Hamida Barmaki was an academic who specialized in civil law. One of few Afghan scholars to have studied both the Islamic and Romano-Germanic legal sources in detail, which are the foundation of the hybrid laws that make up the Afghan legal system. Many journal articles and books in Dari were among her works. She also wrote an academic thesis about the “Interpretation of Statutes” at Kabul University in 2002 and a master thesis on English at the University of Bologna (unpublished 2004). Her final work, a large volume about the law of obligation, was not completed. Hamida Barmaki’s academic research had one goal: to give an in-depth understanding of the complex Afghan legal system. She used both the traditional methods of Islamic and secular interpretations to achieve this goal. However, she also used comparative legal analysis to help solve legal problems that are inherent in other legal systems. To achieve this end, she studied literature in Dari, English, Arabic. Her students and colleagues admired Professor Barmaki for her analytical skills as well as her kindness towards all people she met.

Professor Hamida Barmaki, 4 January 1970 – 28 Jan 2011, was a well-known Afghan law professor and human right activist. In a suicide attack, she was also killed with her family.

Hamida Barmaki was active in human rights advocacy from a young age, outside of her academic career. She was a young radio broadcaster at Radio Television Afghanistan (1985-1987), and developed a keen interest in women’s rights. In the middle of the civil war, she wrote an essay entitled “Women’s Role in the Social Reconstruction of Afghanistan” (Afghanistan-i-Fardah booklet, 1993). She combined her academic work and a strenuous, non-violent political struggle to protect the rights of the most vulnerable Afghan citizens. Hamida Barmaki was able to work publicly after the fall of Taliban and was quickly appointed to high-ranking positions with a lot of responsibility. She was a member of Kabul University’s Women’s Council (2002-2011), and a representative in the Emergency Loya Jirga (2002 and 2009). In 2009, she founded Khorasan Legal Service Organisation, her own human rights organization. KLSO’s primary purpose was to raise citizens’ awareness about their rights and provide free legal assistance for women and other marginalized people. Hamida Barmaki, a potential candidate for the position of Minister of Women’s Affairs (Afghanistan) was mentioned by Presidential Palace in the same year KLSO was established.

From March 2008 until her death, Hamida Barmaki worked as Representative of the Max Planck Institute for Comparative Public Law and International Law (MPIL), a research institute based in Heidelberg (Germany). Together with an Afghan-German team of researchers, she initiated and implemented projects aimed at modernizing the legislation and the judicial institutions of the country, especially the Afghan Supreme Court, and the development of an academic culture in legal sciences on an international level.
