Fernando Bermudez (born February 13 1969) is a New York City resident who was released in 2009 following being found guilty in 1992 in the second-degree murder of a 16 year- old boy in the city’s Greenwich Village. He was sentenced to life. The conviction was reversed after an appeal hearing by an New York County Supreme Court justice, who granted Bermudez a release, dismissing the case without prejudice. Bermudez is an in-person speaking at The Innocence Project.
In 2009, the conviction was rescinded by the New York County justice on appeal. Judge dismissed case with prejudice, on the grounds of Bermudez’s true innocence, meaning that prosecutions cannot retry the case. He served an entire 18-year sentence in the prison.
Media outlets within the New York City area covered the Bermudez case from 2007 to his decision to acquit. The attorney representing him was Barry Pollack. The man who represented him had won an acquittal in 2007 against Martin Tankleff of murder charges.

Bermudez was suspected of being the shooter in a shooting which killed a teenager at a nightclub within Greenwich Village after an altercation. Eyewitnesses identified Bermudez through police photos in the group process followed by a line-up.

In 2011, Bermudez filed a federal civil suit against the City of New York for $30 million. “In 2014, Bermudez was awarded $4.75 million by the New York Court of Claims. In 2017, the city of New York agreed to settle the federal lawsuit for $7 million.”
