Diane Lee (Chinese: Li Qing An born on 17 Jan. 1959) is a Taiwanese former politician. She became an U.S. citizen in 1991 and later renounced U.S. citizenship. Lee is an active Kuomintang member, was elected to official positions across Taiwan from 1994 until 2009, at first as an Taipei City Councilwoman and then for three years as a legislator, representing the Daan District, Taipei City.

In February of 2010, Lee was found guilty of fraud and forgery in Taiwan’s Taipei District Court of fraud and forgery related to the issue of citizenship. She appealed her sentence in Taiwan’s Taiwan High Court, which released her in the month of August. Her case was sent to the Supreme Court of the Republic of China that affirmed her conviction and acquittal.

On January 16, 2009 on the 16th of January 2009, the American Institute in Taiwan issued an official letter that clarified that, under United States nationality law, an individual can be able to lose U.S. citizenship by committing certain actions with the intent to lose U.S. citizenship, as it is the case that the conduct following the act is similar to that of the non-U.S. citizenship. The lawyer for Lee Lee Yung-jan said that this was in support of Lee’s earlier assertion that she had already been stripped of U.S. citizenship upon taking office. Lee also claimed the subsequent actions such as traveling in U.S. on a Republic of China passport instead of a U.S. on a Republic of China passport rather than the United States passport confirmed her intent to lose her citizenship. However Lee’s lawyer argued that it was the Central Election Commission revoked Lee’s status as an elected official in February of 2009. The CEC permitted Lee to keep more than NT$8.6 million in election subsidy due to the fact that Lee’s Election and Recall Act for Public Servants did not preclude natural-born dual citizens from participating at local level elections. Citizenship of another country must be given up prior to the oath to be taken. Her name was listed in the Quarterly Publication of People who have chosen to expatriate in the last quarter of 2009.

Lee claimed that she been stripped of U.S. citizenship automatically upon becoming an Taipei City Councilwoman back in 1994. Lee claimed that the U.S. Department of State sent a letter to the Ministry of Foreign Affairs in the last week of December 2008 that stated that Lee was previously found to be an U.S. citizen and issued with a passport. It also stated there was no request to determine of the loss of citizenship was made, however that a decision could be made upon the additional evidence that an act that resulted in loss of citizenship had been committed. The decision to lose citizenship would take effect retroactively up to date above-mentioned act. But, amid a growing tensions, Lee resigned in January 2009.
