Babich involves several former executives from Insys Therapeutics. The government claimed that the executives had violated the Racketeer Induced and Corrupt Organizations Act (18 U.S.C. 1692 et cetera, in which they allegedly conspired to sell Subsys, a fentanyl- based pain medicine by bribing doctors to prescribe it. Michael Babich, former CEO of Insys, pleaded guilty to the indictments. From January to April 2019, the remaining defendants were being tried. The remaining five defendants, including John Kapoor, a former billionaire, were all convicted of racketeering.

Judge Burroughs also presided over several consumer product class actions, including In re Intuniv Antitrust Litigation. This case concerns allegedly anticompetitive deals between drug makers Shire, Actavis, that are purportedly aimed to charge supracompetitive prices to ADHD medication. The cases were brought against Nestle, The Hershey Company and Mars, alleging that they violated Massachusetts law by failing disclose the use slave labor in their cocoa bean supply line. In re Intuniv Antitrust Litigation class certification opinions of Judge Burroughs (one certifying a group of direct purchasers and one declining to certify a group of indirect consumer purchasers) are well- known for applying the predominance requirement for class certification when putative classes include many uninjured members. The complaints against the chocolate bars companies were dismissed by Judge Burroughs in January 2019. Now, the cases are on appeal. Burroughs dismissed a class action suit in September 2019 that claimed Honey Bunches of Oats cereal’s packaging was misleading due to its limited honey content.

Burroughs was nominated by President Obama to be a United States District Judge of United States District Court of the District of Massachusetts on July 31, 2014.
