In an attempt to end the partisan gridlock, on April 15, 2008, President Bush renominated Kethledge and failed Clinton nominee Helene White to the Sixth Circuit, and Murphy was nominated to the U.S. District Court for the Eastern District of Michigan to replace Judge Patrick Duggan, a vacancy that had remained unfilled since 2000.

After the law school, Murphy served as a trial attorney for the United States Department of Justice from 1987 until 1992. He was appointed as part of the attorney general’s honors program. Murphy was employed in the Civil and Tax Divisions in Washington, D.C. where he represented various federal agencies and prosecuted tax-related criminal instances in Federal District Courts across all of the United States. Then, Murphy worked as an Assistant United States Attorney in Detroit between 1992 and 2000, where he prosecuted and tried a variety of crime involving violence, such as narcotics as well as a number of high-profile white collar legal cases before Detroit’s Federal Court. After his appointment in the position of assistant United States Attorney, Murphy was an attorney for the General Motors Legal Staff in Detroit between 2000 and the year 2005. Bush nominated Murphy and Raymond Kethledge to fill two vacant positions of the United States Court of Appeals for the Sixth Circuit. Murphy was to be appointed to an open seat due to an untimely death of judge Susan Bieke Neilson. At the time of his confirmation, Republicans maintained a majority of seats in the Senate. But, after the midterm elections in 2006 nominating stalled.
