In the summer of 2008, Senate Democrats eliminated the Minority Leader Teresa Fedor and replaced her with Ray Miller, as well as Smith as the assistant minority leader. As of the 128th General Assembly, the caucus continued to retain Smith in her position as the assistant minority leader in the midst of Capri Cafaro.
In the latter part of 2005 Smith made it clear that she was running to succeed in the position of term-limited Prentiss as a member of the Senate as well as Reps. Annie L. Key, Claudette Woodard, and two other Democrats. In a highly contestable primary, Smith defeated the opposition in the race for district 21’s nomination, winning 50.86 percent in the ballot. She was elected the general election winner with 85.34 percent of the voters. The 12th General Assembly, Smith served as the president for the OLBC.

The the incumbent C. J. Prentiss made the decision to run for Ohio Senate, Smith and four other Democrats tried to replace Prentiss in the primary election. Smith took district 8 nominating contest with 35.29 percent of the vote. She was elected the general election over Republican Dominic Rini with 86.15 percent of the votes. Smith won re-election for District 8 on the ballot in 2000 in opposition to Republican Ronnie Jones with 87.2 percent of the vote.
