But the Sopoanga government was defeated by the majority of its members in April 2003 after outcomes of 2003’s Nanumea by- election, as well as that of the Niutao by-election. On August 6, 2003, on the 6th of August 2003, the Chief Justice from the High Court declined to make an order in which the Prime Minister ought to quit; however, the Chief Justice gave instructions as to the governor-general’s procedure to take any action that he believes is appropriate in accordance with the provisions of Section 116(1) of the Constitution of Tuvalu and acting according to his own discretion, not as per the recommendations of the cabinet. This means that the governor-general can consider whether is it appropriate for him to use his reserve power when calling the parliament.
On 26 August 2004, while one of the 15 members of parliament was sick in New Zealand and another had defected from Sapoanga’s group, the opposition finally Sapoanga to resign in a no confidence vote, 8–6.
Sopoanga summoned parliament to convene in September. on 9 September Sopoanga set up a meeting to name the opposition’s MP Faimalaga Luka as governor general which deprived the opposition of its vital one-seat majority and prompting the 2003 Nukufetau by-election. In the election in October, Elisala Pita, joined the government’s benches, allowing it to last until 2004.

Sopoanga was an official in the civil service and from 1997 until 1999, he served as Acting Secretary to the government. The Queen’s birthday Honours the 13th June, 1998, Sopoanga was presented with the honour of Officer with The Most Excellent Order of the British Empire (OBE) for his work in the public sector and for his contributions for the benefit of society. In 2000, he was serving as Secretary to the cabinet of the premier Ionatana Ionatana.
Sopoanga was elected as the Prime Secretary from Tuvalu by the Tuvalu Parliament Tuvalu on the 2nd of August 2002, following the general elections. He was also elected the minister of foreign affairs.
The Sopoanga government was eventually brought down by an eight-to-six motion of no confidence in August 2004. Two government members, Elisala Pita and Otinielu Tausi, crossed the floor to vote against Sopoanga. Saufatu Sopoanga resigned as prime minister and member of parliament on 25 August 2004. The 2004 Nukufetau by-election was held on 7 October and Saufatu Sopoanga regained his seat by a 420-361 vote in his electoral district of Nukufetau. Maatia Toafa was elected prime minister on 11 October 2004 with a vote of 8:7; and Saufatu Sopoanga became deputy prime minister. He was also the minister for communications & transport and minister for works & energy. At the 2006 Tuvaluan general election he lost his seat in Parliament, and thus also his position in the cabinet.
