Also, he hadn’t opted for Yugoslavian citizenship, specifically Serbian citizenship, within the 3 years after turning 21 (which was a condition to keep citizenship by any of six Yugoslavia constituent republics at that time), the FRY authorities declared his status null.

Jovicic was granted a permanent resident visa by Senator Chris Evans, the Labor Minister for Immigration and Citizenship in February 2008.

Amanda Vanstone, Senator of Australia, announced in March 2006 that Jovicic would be granted a special visa and allowed to return home to Australia. Through the then Department of Immigration, Multi-culturism and Indigenous Affairs, she apparently promised Jovicic’s family that he would be allowed to return home and receive a Resident Return Visa (RRV). His lawyer claims that he was also offered access the Reconnecting People Package. This is for the reintegration and rehabilitation of wrongly detained persons. However, it seems that this package has been withdrawn. Jovicic was able to return to Australia on March 9, 2006, although he is still uncertain about his status. The state of uncertainty continued almost for a year until Senator Vanstone, the successor to him as Immigration Minister, granted Jovicic a special protection visa for two years on February 19, 2007.
