Peter Douglas Keisler (born October 13th 1960 at Hempstead, New York) is an American lawyer whose nomination in 2006 from the president George W. Bush to the United States Court of Appeals for the District of Columbia Circuit became involved in a partisan debate. He is a partner of the law firm Sidley Austin located in Washington, D.C., and was previously an Assistant Attorney General for the Civil Division at the U.S. Department of Justice. After departure of the Attorney General Alberto Gonzales, until November 9th in 2007, he served as also the acting Attorney General in the United States.
Following the completion of the Supreme Court clerkship, Mr. Keisler became a partner in the Washington, D.C. office of Sidley Austin. He was a specialist in appellate and general litigation and telecommunications law and also appeared in the Supreme Court and numerous federal Courts of Appeals. The year 2002 was the time he resigned from his job for him to be part of his new position at the Department of Justice. He was appointed to the Department on the 24th of June 2002, and was appointed the Principal Assistant Attorney General and as the Acting Assistant Attorney General.
After the 2006 midterm congressional elections (in which the Democrats reclaimed control of the Senate), President Bush renominated Keisler on November 15, 2006. The Senate returned the nomination to Bush on December 9, 2006 without acting on the nomination, before the 109th Congress’s final adjournment. President Bush renominated Keisler on January 9, 2007 for consideration by the Senate during the 110th Congress. The Democratic leadership of the Senate Judiciary Committee, however, refused to act on the nomination.
Keisler was later nominated for a position on the D.C. Circuit on June 29, 2006 by President George W. Bush to fill a seat vacated by John Roberts, whom Bush appointed Chief Justice of the United States in 2005. At the time, the 109th Senate was controlled by the Republican Party. On August 1, 2006, he received a hearing before the Senate Judiciary Committee. The Senate on September 29, 2006 returned the nomination to the President without acting on it, prior to adjourning for the 2006 elections, on September 30, 2006.
At first, Keisler, a resident of Bethesda, Maryland and a practicing attorney located in Washington, D.C., was thought of as a candidate for the Maryland position in the U.S. Court of Appeals for the Fourth Circuit during the spring of 2001. A 1977 graduate of George W. Hewlett High School located in Long Island, New York, Keisler went to Yale University both for undergraduate as well as law school. While a student, Keisler was the Chairman of the Party of the Right (Yale) as well as the speaker of the Yale Political Union. He received his magna cum laude at Yale College in 1981 and later enrolled in Yale Law School. He graduated in 1982 and assisted in the creation of the Federalist Society, a conservative think tank. He earned his J.D. in the year 1985. Following the law program, Keisler clerked for Judge Robert Bork on the D.C. Circuit from 1985 until 1986. In the following year was completed, he was a part of his position in the Office of Legal Counsel under the presidency of President Ronald Reagan. He worked in the Office of Legal Counsel on both Supreme Court nominations of his former boss, Robert Bork, and the person who succeeded Bork as the Supreme Court nominee, Justice Anthony Kennedy. Following the time that Justice Anthony Kennedy was confirmed the Supreme Court nominee, he hired Keisler to serve as one of the four law clerks he had during the first term of his tenure on the Supreme Court in 1988. One of his co-workers in that time included Miguel Estrada, another conservative candidate for the D.C. Circuit who was a controversial filibuster by Democrats during 2003.
It was in the early days that Democrats on the Senate were not keen to confirm Keisler due to four main reasons. The first was that he was a founder of the Federalist Society, a conservative legal organization that was widely Democrats believed was seeking to take control of over the judiciary in federal court. He served on its Board of Directors from 1983 to 2000. In addition, he worked on behalf of Robert Bork, a conservative Republican judge whose appointment for the Supreme Court was embroiled in controversy, before it was denied in 1987 by the Senate which was controlled by Democrats. Then, during his tenure in his post at the United States Department of Justice and the Department of Justice, he played a key role in protecting certain more controversial decisions that were implemented by Republican Bush. George W. Bush concerning the Global War on Terror. Additionally, he was seen as a potential Republican candidate for the Supreme Court.
Peter Keisler was sworn in as the Civil Division’s Assistant Attorney General on July 1, 2003. Mr. Keisler was involved in defending the Bush Administration’s policies in the Global War on Terror. He has also represented the government in defense of laws protecting access to abortion clinics and imposing requirements on telemarketing companies.
