Uthayakumar’s paternal grandpa, Arunasalam was an Indian citizen from British India in present-day India. Arunasalam was brought to Malaysia at the time it was called Malaya to perform the role of a laborer on the rubber estate.
At 8:00 a.m. on the 3rd of December at around 8:00 am, Uthayakumar discovered that the tires on his Volvo 240 were cut. In the police report, Uthayakumar declared that he suspects of the United Malays National Organisation (UMNO) to be the culprit behind the cutting. He also claimed that a vehicle with number AFL5280 was monitoring his for the last eight months. If something happen to him, he’d accuse the top UMNO leadership of being responsible.
On 19 November 2007, Uthayakumar’s office in Kuala Lumpur was raided by the police to search for a book deemed seditious under the Sedition Act. The police were unable to find the book but instead confiscated some fliers. When Uthayakumar called his brother’s (Waytha Moorthy Ponnusamy) office in Seremban, which was also being raided at the same time, he scolded two police officers for recording the legal office staff’s statements and slammed them for not following procedure.
On 30 October 2007, Uthayakumar and other HINDRAF lawyers – M. Manoharan, P. Waytha Moorthy and V. Ganapathi Rao were arrested at 11:00 p. m. and detained until 8:00 a. m. the following morning for taking part in a demonstration against the demolishment of a Hindu Shrine in Kuala Lumpur. All of the lawyers then filed a suit against seven defendants including the government for the “unlawful arrest” on 5 November 2007. They are seeking 20 million Malaysian Ringgits each in compensation while Waytha Moorthy is seeking 25 million.
Uthayakumar was detained on December 11, 2007 to stand trial on a new sedition charge. In spite of the fact that the highest penalty to be imposed for sedition within Malaysia is 5 000 Malaysian ringgits(ringgits), the bail amount was $50,000 Malaysian Ringgits. Following the time that Uthayakumar was granted his bail amount, he was arrested and taken into Pudu prison. Charges against Uthayakumar were dropped shortly after and the release date was 12 December 2007.

Uthayakumar and his wife Ponnusamy (Tamil: utykumaar ponnnnnnucaami) (born 7 November 1961) is a Malaysian lawyer who is of Tamil origin. He is the elder cousin of P. Waytha Moorthy, HINDRAF (the Hindu Rights Action Force) lawyer who led the team of lawyers who helped start a class action lawsuit to sue the United Kingdom for “abandoning minority Indians to the mercy of majoritarian Malay rule while granting independence on August 31, 1957”. While Uthayakumar is a mere legal advisor for HINDRAF which is a grouping comprised of a variety of non-governmental organizations and non-governmental organizations, he is considered to be the official chief of HINDRAF.
On the 13th of December 2007 Uthayakumar along with others HINDRAF Members M. Manoharan, V. S. Ganapathy Rao, K. Kengadhadran and T. Vasantha Kumar were detained pursuant to the Internal Security Act (ISA). There are reports that suggest the 13th of December was selected to symbolize the incident of 13 May. Uthayakumar left two videos of his final days to his fans, stating that he was prepared for to be arrested in the context of ISA. Uthayakumar expressed his gratitude to HINDRAF members for the help and encouraged them to remain non- violent and not to use violence. The ISA detainee was freed in 2009. ISA detention in 2009.
Police arrested Uthayakumar in the morning of 23 November 2007 to prevent him from taking part in the 2007 HINDRAF rally. He was given a discharge later for an error on the part of the prosecution.
