Cohen was taken to psychiatric treatment and hospitalized on July 24, 2008. This was after investigators from New Jersey Attorney General’s removed a state-issued computer that had been in his legislative office. They were investigating claims that it had been used for child pornography storage. After staffers discovered the material on the computer, State Senator Raymond Lesniak, and Assemblyman Joseph Cryan both shared a Union Township office.
Cohen submitted a one-sentence resignation letter to the General Assembly stating that he had resigned as a member of the General Assembly. Assembly Speaker Joseph J. Roberts accepted Cohen’s resignation immediately. Annette Quijano was selected by the Democratic Committee members of the district to fill Cohen’s vacant position.

Cohen was a member of the Union County Board of Chosen Freeholders between 1988 and 1990. Cohen is an attorney at Gill & Cohen P.C. Together with Nia Gill, a 34th Legislative District Assemblywoman. Cohen served as an aide to the New Jersey Department of Environmental Protection in 1976. He was a trial lawyer in the Office of the Public Defender from 1979 to 1981.
From 2002 to his resignation, Cohen was Deputy Majority leader in the Assembly. He was also Deputy Minority Leader 1996-2001. In 1994-1995, he was Minority Whip.
Cohen was indicted for official misconduct (2nd degree), reproduction of child pornography (2nd degree), distribution of child pornography (2nd degree), and possession of child pornography (4th degree). In a plea agreement, the state dropped the official misconduct charge and three of four child pornography counts, and on April 12, 2010, Cohen pleaded guilty to the charge of endangering the welfare of a child by distributing child pornography. Initially facing up to 30 years imprisonment, State Attorney General Paula Dow sought a five-year prison term for Cohen, as well his disbarment. He was sentenced to five years and was incarcerated from November 4, 2010 until January 4, 2012, when he was released on parole.
