President Obama nominated Selby on January 12, 2016 to be a United States Circuit Judge of United States Court of Appeals For the Seventh Circuit. This seat was vacated by Judge John Daniel Tinder who retired on February 18, 2015. With the expiration of the 114th Congress, her nomination was withdrawn.

She was elected to the Indiana Supreme Court in 1995. In that capacity, she was both the first African American woman and the first female appointed to the highest court in Indiana. She authored over 100 majority opinions during her tenure on the court. These included landmark decisions in tort law reform and medical malpractice claims. She retired from the bench in 1999 and went back to private practice, becoming a partner at Ice Miller. In 1999, she resigned from the bench and was asked by the Indiana Supreme Court to head the newly created Commission on Race and Gender Fairness. She is still the Chair of the Commission. The Commission studies and makes recommendations to improve gender and racial equality in the legal system. Her private practice focuses primarily on commercial litigation, with a special emphasis on health care.
