He was also nominated to the United States Court of Appeals, Eleventh Circuit, that same day. While his nomination was still pending before Senate Judiciary Committee [The New York Times] Sen. Patrick J. Leahy who headed the Judiciary Committee said that “it had become obvious after talking with his colleagues that Mr. Boggs could not win committee support Mr. Boggs is the unique distinction of being the first Obama judicial nominee this year to fail due to Democratic opposition.” David Scott, U.S. Rep. Georgia’s 13th District, criticised Boggs’ nomination because Boggs’ votes to keep the Confederate insignia on the Georgia state flag, ban same-sex marriage, and restrict abortion. Boggs was part of a group that received approval from Georgia’s U.S. Senators to allow votes for their nominations in a “package deal”. On May 13, 2014, he was given a hearing by the entire United States Senate Judiciary Committee.
