Lecretia Anne Seales (4 April 1973 5 June 2015) was a New Zealand lawyer who, after suffering from a brain tumor and the long-term treatment for it she became a proponent of medically assisted dying.
In 2011, Seales received a diagnosis of a tumor in her brain. She underwent chemotherapy, brain surgery and radiotherapy, however her condition did not worsen. In 2015, she filed an appeal before the High Court to challenge New Zealand laws that protected the right of dying with the help of her physician, and asking for a statement that her doctor will not be liable for being found guilty. The claim was split into two parts. In the first instance , she sought the Court to decide that her doctor will not be found guilty of aiding suicide or murder by helping her die due to what she was suffering from her disease and her prognosis. In the absence of that, she sought a declaration by the Court that the “Crimes Act” is inconsistent with her fundamental rights and freedoms including the right to not be denied life, and the right to not be victimized by brutal or inhuman treatment as stipulated in the New Zealand Bill of Rights. The alternative declaration may not have implied that a physician could legally offer aid to a dying terminally ill patient it would have proved that the law as it is, is inherently unjust and could have force the legislature to alter the law.
In August 2016, Seales’ widower Matt Vickers published a memoir, Lecretia’s Choice, detailing his relationship with Seales and her decision to take the High Court case.
