On September 14 on the 14th of September, 2018 The American Bar Association’s Standing Committee on the Federal Judiciary gave Kobes “Not Qualified.” The ABA’s report stated the following: Kobes is “a very accomplished, competent, and capable person, but his career path has not resulted in sufficient evidence of a developed ability to do the written work of a United States circuit court judge.” The ABA report raised questions about Kobes knowledge of “complex legal analysis” and “knowledge of the law”. When he was nominated, appointment, Kobes had tried six cases in his career as a lawyer cases that the ABA judged to be simple but did not appear to be “legally complex”.

On the 11th of October, 2018, Kobes’ nomination was removed from the Senate Judiciary Committee by a majority of 11-10 on a party-line. On November 29, 2018 the Senate decided to invoke the cloture procedure on Kobes nomination with 50-49 votes and the Vice-President Mike Pence breaking the tie. On December 11, 2018 the nominee was confirmed in the Senate with an overwhelming 51-50 vote, with Vice President Mike Pence voting with a positive vote. Kobes was the first federal nominee for judicial position to be confirmed through an unanimous vote. Kobes was appointed to his judicial commission on 12 December 2018.
