Mackintosh was born in Fort Frances, Ontario, and went on to study at in the University of Manitoba. Prior to entering the political arena, Mackintosh was employed by his employer, the Canadian Human Rights Commission and the Manitoba Human Rights Commission between 1979 and 1984. He also served as the Deputy Clerk for the Manitoba Legislature from 1980 to 1984. He was admitted into the legal profession in 1988. He served as the chair for the Committee on Patient Rights from the year 1986 until 1992 as well as a member of both the Rainbow Society and the Manitoba Anti-Poverty Organization. In his legal profession the lawyer was a specialist in environmental law, and also served as an adviser for Elijah Harper during the Meech Lake constitutional debates in 1990.

Mackintosh was elected to the provincial legislature in September 1993. He won an election by-election in the northern Winnipeg district in St. Johns (replacing Judy Wasylycia-Leiswho quit to contest in the Federal House of Commons). Mackintosh got 3232 votes in contrast to 878 votes for his closest opponent, Liberal Naty Yenkech. In the 1995 provincial election, Mackintosh was re-elected in St. Johns with 4513 votes, as opposed to 1610 votes in favor of Liberal Bron Gorski. This election went to Gary Filmon’s Progressive Conservatives, and Mackintosh joined with 22 other New Democrats in the official opposition.

As Attorney General, Mackintosh oversaw the extension of children’s rights in the legal system, and supported the creation of Cybertip.ca by Child Find Manitoba to report on online predators and child pornography. In addition, Mackintosh oversaw new initiatives in aboriginal and community justice, and made efforts to target organized crime in Manitoba. On November 1, 2004, Mackintosh’s department announced that it would introduce tough anti-gang legislation, which would permit the province to confiscate the assets of suspected gang members even if no criminal convictions have occurred.
