He was previously the assistant United States Attorney for the Southern District of New York from 1990 until 1994. In January of 2018, U.S. Attorney General Jeff Sessions announced Berman’s appointment as interim U.S. Attorney for a time period of 120 days as a statutory requirement. Berman was later an assistant United States Attorney for the Southern District of New York from 1990 until 1994. Berman was involved in a variety of complex tax and fraud trials as prosecutor, such as his involvement in the Masters of Deception computer hacking case. Because of Berman’s investigation into the case his effigy was cut on the front of 2600: The Hacker Quarterly the magazine that dealt with computer hacking.
