During the 32nd legislative session, Fairclough served as opposition critic for Health and Social Services, Community Services, Education, the Public Service Commission, the Yukon Liquor Corporation, and the Yukon Housing Corporation. In addition, he served as the Liberals whip.

Fairclough was reelected as an official part of the New Democrats in 2000 election, however that one resulted in his party being cut to official Opposition status. Fairclough was elected the interim leader of the New Democrats when Trevor Harding who was the previous temporary leader of the party, chose to step down from politics. Harding was the successor to New Democrat leader Piers McDonald who had lost during the night of the election. Fairclough was eventually a candidate for the his position as leader in the New Democrats, but withdrew. The former Whitehorse Centre MLA Todd Hardy who dropped his seats in 2000 elections He was elected as the party’s leader in 2002.

Fairclough was comfortably re-elected in his riding in the 2006 Yukon election, capturing half the vote. McRobb too was re-elected, and the Liberals retained their Official Opposition status under a Yukon Party majority government.

However, he was later expelled in 2006 from the New Democrat caucus by leader Todd Hardy when it was discovered that he and his colleague, Kluane MLA Gary McRobb, were publicly consulting constituents about considering quitting the New Democrats for the Liberals due to Hardy’s isolated decision-making and a lack of faith in his leadership. Fairclough had also insisted upon Hardy calling a leadership race, but Hardy had refused.

Eric Fairclough is a Canadian politician who served as an official in the Cabinet as well as leader of the official Opposition within the Yukon Legislative Assembly. He was a representative of in the remote Yukon election district, Mayo-Tatchun within the Yukon Legislative Assembly from 1996 until 2011 in both Yukon New Democratic Party as well as the Liberals. He was also the past Chief of Carmacks/Little Salmon First Nation.
