The extradition impedes the investigation and prosecution of such grave crimes through the avenues established by the Justice and Peace Law in Colombia and through the Colombian justice system’s regular criminal procedures. It also closes the door to the possibility that victims can participate directly in the search for truth about crimes committed during the conflict, and limits access to reparations for damages that were caused. This action also interferes with efforts to determine links between agents of the State and these paramilitary leaders.”

When he was a child He became a member of at a young age, he joined the Popular Liberation Army. His team was involved in the kidnapping of a drug dealer who, in retaliation, murdered all squad members, with the exception of Murillo who managed get away to Itagui. In Itagui, he became familiar with members of the Galeano family, who were the partners of Pablo Escobar and members of the Medellin Cartel. The Galeanos were the ones who controlled what was then known as the Oficina of Envigado. Murillo was one of the top advisers of the family and it was for this reason that he suffered the injury from a gun that caused him to have an indefinite limp. The Galeanos did, however, fall out of favour with Escobar who had them to be killed in the year 1992. Murillo was able to stay alive and later was a part of Los Pepes, an organization led by the Castano brothers, Carlos and Fidel to combat Escobar. Murillo also managed to take control over the illegal business run by Galeanos in Itagui and The Oficina de Envigado.

Then, Murillo had become the head of the numerous hitmen and criminal gangs that were operating in Medellin especially the feared La Terraza, which was involved in blackmail, theft assassination, extortion kidnapping, as well as trafficking in drugs. In 2000, however members from La Terraza rebelled against Murillo and launched a battle against Murillo. At that time, Murillo had become well acquainted with the Castano brothers and became the commander of two paramilitary groups which included The Cacique Nutibara Bloc and Granada Heroes Bloc. He also seized control of most of the drug trade within the region.

In the early morning of May 13, 2008, Murillo Bejarano and 13 other paramilitary leaders were taken from their jail cells in a surprise action by the Colombian government. According to Colombian Interior Minister Carlos Holguín, they refused to comply with the country’s Peace and Justice law and were therefore extradited to the United States. Many critics argued that this action would actually be favorable to the criminal as he would only be charged for drug trafficking in the United States, as opposed to being charged for his many murders and other illegal activities in Colombia. The next day, Don Berna pleaded not guilty to money laundering and drug trafficking charges filed by United States (federal) prosecutors of the Southern District of New York State. The judge ruled the trial would begin September 16, 2008.
