Noteworthy prosecutions by her office include those of Whitey Bulger, Tarek Mehanna, and Dzhokhar Tsarnaev, as well as the controversial prosecution of Aaron Swartz.
Ortiz’s office attempted to seize the Motel Caswell, Tewksbury Massachusetts, from Russ Caswell. Prosecutors claimed that Caswell had not been charged with any crime and that his property was subject of civil forfeiture because it was a site for long-term criminal activity. Ortiz spokeswoman, saying that the government considered this an important case. This was not only for Tewksbury which has been plagued by Motel Caswell’s criminal activities, but also because it sends a deterrent message to other people who might turn a blindeye to crimes occurring at their business. Caswell stated that the property was where 15 drug crimes occurred between 1994 and 2008. He rents approximately 14,000 rooms each year. Caswell was represented in court by the Institute for Justice. This non-profit, libertarian law firm is involved in asset forfeiture cases.

Ortiz was born in New York City to Puerto Rican parents. She grew up in East Harlem. Ortiz claims that Perry Mason’s television show inspired her to become an attorney as a child. After graduating from The Saint Agnes School, Ortiz received her B.B.A. from Adelphi University in 1978. She worked in her family’s gift shop for many years. Later, Ortiz earned her J.D. In 1981, Ortiz graduated from George Washington University’s National Law Center. Ortiz worked as an intern in the Public Integrity Section of United States Department of Justice during the summer 1980 with Eric Holder, later to become U.S. Attorney. With Philip Heymann, a Harvard professor and former Watergate prosecutor, she worked on Guatemalan judicial reform.
Ortiz worked as an attorney in the United States Department of Justice Criminal Division from 1981 to 1983. Ortiz was Assistant District Attorney for Middlesex County in Massachusetts from 1983 to 1988, and 1991 to 1994. Ortiz entered the private sector in 1988 with Braintree law firm Marinelli & Morisi. She would remain there until 1989. Ortiz was also the coordinator of Harvard Law School’s Center for Criminal Justice from 1988 to 1991. After being appointed by Paul Tagliabue as NFL Commissioner, Ortiz served on a committee that investigated sexual harassment allegations against New England Patriots players in 1990. In 1997, Ortiz became an Assistant U.S. Attorney.
Ortiz was “admonished by a federal appeals court in 2004 for advocating a harsher jail term for a fraud defendant than she had promised him in a plea- bargain agreement.” In a plea deal, Ortiz had agreed to leniency, but she “substantively argued” for a harsher sentence. The Appeals Court ruled that Ortiz “violated the plea agreement it entered into with Gonczy,” and it vacated the sentence.

Carmen Ortiz led the prosecution of American pharmacist Tarek Mehanna, who was accused of, among other crimes, translating and posting online materials described by prosecutors as Al Qaeda propaganda. Mehanna’s lawyers argued that he never tried to join an armed group and never tried to hurt anyone, and that his internet activities were protected under the U.S. First Amendment. In April 2012, Mehanna was sentenced in federal court in Boston on four terrorism-related charges and three others related to lying to agents of the FBI and other U.S. federal officials.
