The year 2018 saw Pettyjohn reverted his previous support for his earlier support for Delaware Equal Rights Amendment and was among five Republican senators who voted against the amendment.

In June of 2017, Pettyjohn was charged with an offense of felony possession of an unlicensed firearm on a plane after a gun loaded with ammunition was discovered in his carry-on baggage during a security check at Salisbury Regional Airport by TSA agents. Pettyjohn did not possess an authorization to carry concealed in Maryland but at the time, he had an existing Delaware concealed carry permit. He claimed he had a mistake and forgot that the firearm was in his laptop bag and could have been sentenced to 10 years in prison for the offence. He was able to stay clear of an arrest and jail time when he was sentenced to 18 months ‘ probation before a judgement. He was also ordered to surrender his firearm as part of the plea bargain. Pettyjohn often speaks against and opposed to lawful gun control measures.

Department of Elections refused, and the Delaware Republican Party brought legal suit at the Department of Elections. After favorable decisions by Delaware Supreme Court and the Delaware Court of Chancery and Delaware Supreme Court, Pettyjohn was put on his November election ballot. He was elected by a little less than 60% of the votes. Pettyjohn was unopposed to reelection in the primary election of 2016 as well as the general election.
