In May 2002, van der Ham was elected Member of Parliament. He was elected again in 2003, 2006 , and 2010 with a preference vote. Together with the members of GroenLinks as well as The Labour Party he drafted the legislation which resulted in an election in 2005 for the European Constitution referendum, the first time in the country’s history that a referendum was held in 200 years. He also drafted other successful bills, including others: the possibility of amend parliamentary legislation through people-led referendums, an amendment to give equal rights to handicapped and gay people in the Constitution and a bill to remove the prohibition on blasphemy, legislation to amend the prohibition on shopping on Sundays , and a plan to make the process of forming of the new administration more open. He was elected in the month of November, 2006 and was elected deputy head of the party. He emphasized issues of education drugs, culture economic affairs, mass media as well as energy and environment and democratic equality, social justice, and freedom of expression. In 2007, he wrote an article titled Voortrekkers and Baanbrekers (“In The Front Row”) on the role played by the Netherlands in the European Union after the European Constitution referendum. In 2012, he published an article entitled “The Morality of Freedom” (“De Vrije Moraal”) about the past and complexities of society that is permissive. In 2012, he decided not to stand for an election for a second term in the Parliament, and declared that the time-out was a political one’. He was a MP until the 19th of September, 2012.
