Bahr Idriss Abu-Garda (born on January 1, 1963) is the leader of the United Resistance Front, a rebel group that is fighting against the Sudanese government in Darfur. On the 7th of May, 2009 the Pre-Trial Chamber found that there existed evidence that suggested there was evidence that Abu Garda was responsible on three charges of war crimes, including murder, pillaging, and conducting attacks on individuals, installations, materials and vehicles that were involved in peacekeeping missions. The prosecutor claimed that the warrant for arrest was not needed because Abu Garda had expressed his willingness to appear before the court, and so they issued an order directing that he appear in court the 18th of May 2009. Abu Garda flew to The Hague with a commercial airliner on May 17 becoming the very first person to show up in a voluntary manner in front of the ICC.
Abu Garda was summonsed to appear before the International Criminal Court for alleged war crimes relating to a 2007 attack in which twelve African Union peacekeepers were killed. He is the first person ever to appear voluntarily before the ICC, and the first person to appear before the court in connection with the war in Darfur. He denied the allegations against him: “I am looking forward to clear my name from this case because I am sure … that absolutely I am not guilty”. The hearing to confirm the charges against him was held from 19–29 October 2009, ending in a decision by the judges not to confirm the charges and a rejection 23 April 2010 of an appeal by the Prosecutor.
Following his first presence before the courts on the 18th of May 2009, he departed the Netherlands in order to go back to his troops. The hearing to determine his charges ran between 19 and 29 October 2009 and concluded on February 8 between 23 and April, with the charges being dismissed and the Prosecutor’s appeal was rejected.
